Section 100.03

 Grievances  

I. Scope:

 

This standard shall apply to any members who believe they have a legitimate reason to file a complaint or grievance.

 

II. Grievance Procedure:   

   

A.   A grievance is a complaint or dispute by a member relating to employment, including the following:

1.     Disciplinary actions involving dismissal, demotion or suspension, provided that dismissals are grievable whenever resulting from formal discipline or unsatisfactory job performance.

2.     The application of personnel policies, procedures, rules and regulations.

3.     Complaints of discrimination on the basis of age, color, disability, ethnicity, national origin, political affiliation, race, gender or sexual orientation.

B. Any complaint pertaining to a classification or the classification process or the evaluation of an instructor or teacher’s preparation, shall not be considered a grievance and shall not be subject to the grievance process.

C. A complaint alleging sexual harassment, unjust treatment, discrimination or alleging unfair or unsafe work conditions may be presented as a grievance directly to Level 3 of the grievance process.

 

III. Grievance Process:

 

A.   Level 1 – A member wishing to pursue a grievance shall submit in writing within seven (7) days of the date upon which the subject of the grievance occurred, or the time the member first became aware of the subject of the grievance to his respective Captain.

B.    Level 2A member not satisfied with the reply at Level 1 shall, within seven (7) days of the receipt of that decision, submit his grievance in writing to the Officer in Level 2.    

The Officer at Level 2 shall reply in writing to the member within fourteen (14) days of the receipt of the grievance at Level 2 and shall submit a copy of his reply to the Disciplinary Committee.

C.   Level 3A member not satisfied with the reply at Level 2 shall within seven (7) days of receipt of that reply, submit his grievance in writing to the Disciplinary Committee.

The Disciplinary Committee at Level 3 shall reply in writing to the member within fourteen (14) days of the receipt of the grievance at Level 3.
